Key TCPA Requirements

Prior Express Written Consent

For telemarketing calls using an autodialer or prerecorded voice, you must have prior express written consent. This means the consumer must have signed (physically or electronically) an agreement that clearly authorizes calls and includes the phone number to be called.

Do Not Call Compliance

You must maintain an internal DNC list and honor requests within 30 days. You must also scrub against the National DNC Registry (updated every 31 days minimum) and applicable state registries.

Calling Time Restrictions

Telemarketing calls are prohibited before 8 AM or after 9 PM in the recipient's local time zone. Some states have stricter requirements.

Identification Requirements

Callers must identify themselves, the company they represent, and provide a callback number. This must happen at the beginning of the call.
