Terms of Service

1. Acceptance of Terms

By accessing or using SEE AI's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including customers, agents, and any other parties accessing the Service.

2. Description of Service

SEE AI provides an AI-powered voice automation platform for outbound calling, including but not limited to: automated dialing, AI voice agents, call transcription, analytics, lead management, and warm transfer capabilities. The Service is provided on a subscription basis.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years of age
  • Have the authority to bind your organization to these Terms
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations, including TCPA, TSR, and state telemarketing laws
  • Call numbers on the National Do Not Call Registry without proper consent
  • Make calls outside of permitted calling hours
  • Transmit fraudulent, deceptive, or misleading content
  • Harass, abuse, or harm others
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service for any illegal purpose

5. Compliance Obligations

You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:

  • TCPA: Telephone Consumer Protection Act requirements for consent and calling restrictions
  • TSR: Telemarketing Sales Rule requirements
  • State Laws: State-specific telemarketing and privacy regulations
  • DNC: Do Not Call list compliance at federal and state levels
  • GDPR/CCPA: Data protection regulations as applicable

While we provide compliance tools, you remain responsible for proper configuration and use.

6. Payment Terms

  • Fees are charged according to your selected plan
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days' notice
  • Overdue payments may result in service suspension
  • You are responsible for all applicable taxes

7. Intellectual Property

The Service, including all software, content, and documentation, is owned by SEE AI and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service for its intended purpose. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Data and Content

You retain ownership of all data you upload to the Service ("Your Data"). You grant us a license to use Your Data solely to provide the Service. You are responsible for ensuring you have the right to use and upload Your Data, including any personal information of third parties.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE CAUSE OF ACTION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless SEE AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violation of these Terms. Upon termination, your right to use the Service ceases, and we may delete your data after a reasonable retention period.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
